eBay Enforces the FCC ID Rule on Radio Listings (2026)
Share
eBay began enforcing the FCC's online marketplace equipment rule on October 13, 2026, requiring that radio transmitting equipment subject to FCC authorization carry its FCC ID in the listing itself. For scanner buyers the change is narrow: it governs what uncertified two-way radios can be offered for sale on eBay, not what your receiver can hear.
The enforcement rollout is the new part. The rule underneath it is not. It has been on the books since the Third Report and Order in ET Docket No. 21-232, and its formal compliance dates still sit months away. Here is what eBay is actually restricting, what it exempts, and what to check before you pay for a radio online.
What eBay Started Enforcing on October 13, 2026
eBay's Seller Center policy now requires that radio transmitting equipment subject to FCC authorization have an FCC ID submitted and posted with the listing (eBay Seller Center). The requirement took effect October 13, 2026, the same day the wider FCC marketplace framework began to be applied to online sellers.
eBay's stated position is that gear capable of transmitting outside the amateur bands must hold an FCC equipment certification to be imported, advertised, sold, or operated in the United States, including on eBay.
The Rule Behind eBay's Change
The FCC published this rule before eBay acted. The Third Report and Order in ET Docket No. 21-232 (FCC 26-50) amends 47 CFR 2.803(c) to require online marketplaces to display a certified device's FCC ID at the online point of sale, with compliance dates of March 1, 2027 and June 1, 2027 (Federal Register).
eBay moved roughly five months ahead of the first federal compliance date. That timing is the story: marketplace behavior is shifting before the legal deadline does. We covered the rule itself in FCC ID at Checkout: Marketplace Radio Rule Starts 2027, and the related federal equipment restrictions in FCC Covered List Rule Hits Police Radio Gear Oct 13, 2026.
What eBay Exempts
ARRL reported on October 16, 2026 that eBay clarified four carve-outs (ARRL):
- Ham-band-only gear. Equipment operating exclusively on amateur radio frequencies is exempt because it requires no FCC equipment authorization.
- Listings already online. Existing listings are not pulled.
- Small sellers. eBay's policy does not apply to them.
- Used equipment. Secondhand gear is exempt from the listing requirement.
Two-way VHF/UHF radio equipment capable of operating outside of the amateur frequency bands cannot be imported, advertised, sold, or operated within the United States, including on eBay, without an FCC equipment certification.

What This Does Not Change
Read the scope carefully. The rule restricts listings of transmitting equipment. It does not restrict what a receiver can hear, and it bans no scanner. This update does not affect a receiver-only device, does not touch encrypted systems, and adds no new monitoring restriction. If your county already encrypted its dispatch channel, a listing rule on eBay changes nothing about that.
What to Check Before You Buy a Radio Online
- Look for the FCC ID on the listing. Certified transmitting gear should now show one. If a listing makes no mention of it, ask the seller before you pay.
- Know which class of device you are buying. Ham-band-only gear is exempt. A radio that transmits on business or public safety bands is not.
- Buy where the product is supported. A pre-programmed scanner with a support channel is simpler than a gray-market import with no paperwork trail.
If you want a receiver that is ready to listen the day it arrives rather than a transmitter you have to certify yourself, our pre-programmed Baofeng UV-5R Plus ships with your area's frequencies already loaded.

FAQ
Does the FCC ID rule mean I cannot buy a police scanner on eBay?
No. The rule covers equipment subject to FCC authorization at the online point of sale. Receivers are not banned, and eBay has not pulled scanners from the marketplace. What changes is the paperwork around listings for two-way transmitting gear.
Why is ham-band-only gear exempt?
Because that equipment requires no FCC equipment authorization. eBay told ARRL its policy will not apply to gear operating exclusively on amateur radio frequencies.
When are the formal FCC compliance dates?
March 1, 2027 and June 1, 2027, per the Third Report and Order in ET Docket No. 21-232 (FCC 26-50). eBay's own marketplace enforcement began earlier, on October 13, 2026.
Does this affect the used radios I already own?
No. eBay exempts used equipment, and it exempts listings already online. The rule governs marketplace listings, not ownership or use.
Can an FCC ID tell me whether a scanner decodes encrypted traffic?
No. An FCC ID is an equipment authorization identifier, not a capability specification. Encryption is a setting on the agency's own network, and no FCC ID changes whether your scanner can decode a channel.
Bottom line: eBay started enforcing the FCC ID rule on radio listings on October 13, 2026, and it left ham-band-only gear, used equipment, and existing listings alone. Nothing in the change alters what a scanner can hear. The real effect is a cleaner marketplace for transmitting gear, and a reason to check the paperwork before you pay.
